There are some weeks-long periods lately when Linda Greenhouse's writings are the only thing that keep me subscribing to the NYT. The Roberts Court has clearly thrown down the gauntlet, daring the American People to do anything about their rank crusade to conduct a rear-guard action for the white oligarchs who put them in power. Education for all young people living in the United States, regardless of their immigration status, is in the best interests of citizens who make up the overwhelming majority of our population. The alternative is corrosive to our economy, our community and our collective moral compass.I think a case can be made for impeachable offenses by Roberts, Alito and Thomas. We owe it to ourselves and our children.
The damage is being inflicted precisely to insure against the moment when old white people are no longer the majority, with particular deference to very rich old white people. In the end, the Roberts legacy will be about more than just undermining the rights of ordinary working Americans to unionize, organize, and litigate. It will prove to have been about paving the way for a kind of all-American apartheid. In a generation or so--maybe less, maybe as soon as the presidential election of 2016--we will wake up to the reality that thanks to John Roberts and his confreres, our voting laws have been deftly tweaked to enable a powerful racial/economic minority to govern even in the absence of consensus, even without the consent of the majority.
